BIR asks DOJ to sue trader, manufacturer in latest tax evasion cases ...

Government's main collection agency, the Bureau of Internal Revenue (BIR), has filed 129 tax evasion cases worth P43.073 billion before the Department of Justice (DOJ), latest BIR data showed Thursday.

Of the total number, 106 remain pending before the Justice?Department.

On Thursday, the BIR filed its 128th and 129th cases under its Run After Tax Evaders (RATE) program.
?
It filed tax evasion charges worth P78.47 million against a Pasig City-based bag maker and a Mandaluyong City-based machine trader, the bureau said.
?
The agency is running after P50.83 million in deficiency taxes against Philpackaging Corp., a taxpayer registered in Pasig, BIR Commissioner Kim Henares said.
?
The amount comprises deficiencies of P14.43 million in income tax and P36.4 million in value-added tax (VAT) for 2010.
?
In its filing, the BIR asked the Justice Department to file criminal charges against Philpackaging Corp., its president Camino Benedicto and its treasurer Juanito Benedicto for attempting to evade taxes and failing to supply the bureau with correct and accurate information in its tax returns.
?
The company makes and sells plastic woven cloth and bags for wholesale and retail customers, the bureau noted.
?
According to the BIR?s investigation, Philpackaging sales amounted to at least P205.74 million in 2010 but declared sales of only P42.41 million.
?
The sales it declared for one year did not event make a quarter of the purchase of a single customer, Republic Cement. to which it sold P186.3 million worth of goods, the BIR noted.

The bureau is also running after PKC International Trading Corporation for P27.64 million in tax deficiencies for 2011 and is seeking criminal charges against its president Jeremy Kalaw, chief operating officer Christian Pineda, and chief financial officer Joseph Kalaw for attempting to evade taxes and failing to supply the BIR with correct and accurate information in its tax returns.

The bureau claimed an informant told BIR officials that PKC International underdeclared its sales ? apart from not always issuing sales invoices and official receipts.

Investigation showed that the company?s sales amounted to at least P42.14 million, but only P1.69 million was declared in its tax returns, Henares said.

During the first nine months of 2011, International underdeclared sales by P41.16 million in its VAT returns and declared only P980,000, the bureau claimed in its charge sheet. ? VS, GMA News
